Terms of Service

Last updated: October 14, 2026

These Terms govern use of SwiftAppraise (swiftappraisaldocs.com), provided by Ember Development Studios, LLC. The person who signs up a firm accepts these Terms for that firm and confirms they are authorized to do so. Everyone who uses the firm’s account must follow them.

1. The service

SwiftAppraise helps appraisal firms prepare FDOT right-of-way appraisals and Review Appraiser’s Statements (Form R/W 1/1/14), route them for approval inside the firm, and download or email the final packages. It includes AI-assisted extraction from uploaded documents and comparable sales drawn from public county records.

2. Professional responsibility

SwiftAppraise is a tool; it does not appraise or review property. Your firm and its appraisers are solely responsible for the contents, conclusions, accuracy and compliance (including USPAP, Florida law and FDOT requirements) of every appraisal and review prepared with it, and for checking every AI-extracted value and every comparable sale before relying on it. An approval in SwiftAppraise records your firm’s own decision; we do not verify certifications or the work.

3. Accounts

4. Trial, plan and billing

5. Your content

Your firm keeps all rights to the content it uploads or creates. You grant us the limited right to host, process and transmit it only to provide the service to your firm, including sending the emails your members request. You confirm you have the right to upload it, including other firms’ appraisals and the personal information they contain.

6. Acceptable use

Do not misuse the service: no unlawful content, no attempts to reach other firms’ data or to defeat security controls, no reverse engineering or automated scraping, no reselling access, and no emailing work through SwiftAppraise to anyone who has not asked to receive it.

7. Availability and changes

We work to keep SwiftAppraise available and secure but do not guarantee uninterrupted service. We may improve or change features; we will not remove the ability to download your firm’s packages without reasonable notice.

8. Termination

Your firm may cancel at any time. We may suspend or end access for non-payment or a serious breach of these Terms. After an account ends, your firm can ask us for its data within 30 days; after that it may be deleted as described in the Privacy Policy.

9. Disclaimers

The service, its AI features and the public-record data are provided “as is”. To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and the accuracy of public records or AI output.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and our total liability for any claim is limited to the amount your firm paid us in the 12 months before the claim.

11. Governing law

These Terms are governed by the laws of the State of Florida, and any dispute will be resolved in the state or federal courts located in Florida.

12. Changes and contact

We may update these Terms and will change the date above; we will tell account owners about material changes before they take effect. Questions: support@emberdevstudios.com.
